DISCLAIMER OF IMPLIED WARRANTIES
To the fullest extent permitted by law, NXG Arms expressly disclaims all implied warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. No advice, information, or representation provided by NXG Arms shall create any warranty not expressly stated in these Terms of Sale.
LIMITATION OF LIABILITY FOR PERSONAL INJURY AND PROPERTY DAMAGE
Under no circumstances shall NXG Arms be liable for any personal injury, death, property damage, or other loss arising from the use, misuse, installation, modification, or handling of any NXG Arms product. The buyer acknowledges that firearm components and related products involve inherent risks and assumes full responsibility for all such risks.
ASSUMPTION OF RISK
By purchasing or using any NXG Arms product, the buyer acknowledges and agrees that they assume all risks associated with the installation, handling, storage, modification, and use of the product. The buyer further agrees that NXG Arms shall not be responsible for any damages or losses resulting from improper installation, improper torque, incorrect tools, failure to follow instructions, or use in any unsafe manner.
MODIFICATIONS AND AFTERMARKET PARTS
Any modification, alteration, or use of NXG Arms products with non‑factory, aftermarket, or third‑party components is performed at the sole risk of the buyer. NXG Arms makes no guarantee of compatibility with any aftermarket parts. Any such modification immediately voids all warranties, protections, and claims against NXG Arms.
INDEMNIFICATION
The buyer agrees to indemnify, defend, and hold harmless NXG Arms, its owners, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) the buyer’s use or misuse of the product;
(b) improper installation or modification;
(c) violation of any applicable law or regulation;
(d) claims brought by third parties resulting from the buyer’s actions or omissions.
This obligation survives the completion of the transaction.
LEGAL COMPLIANCE
The buyer is solely responsible for determining and complying with all federal, state, and local laws regarding the purchase, possession, installation, and use of NXG Arms products. NXG Arms makes no representation regarding the legality of its products in any jurisdiction. NXG Arms shall not be liable for any legal consequences, penalties, or damages resulting from the buyer’s failure to comply with applicable laws.
COMPATIBILITY DISCLAIMER
NXG Arms products are designed for use with factory‑specification Ruger® 10/22® components unless otherwise stated. NXG Arms does not guarantee compatibility with aftermarket receivers, barrels, triggers, stocks, or accessories. The buyer assumes all risk associated with combining NXG Arms products with non‑factory components.
FINISH AND COATING DISCLAIMER
Cerakote and other finishes applied by NXG Arms may experience normal wear, abrasion, fading, discoloration, or chemical reaction depending on use and environmental conditions. NXG Arms does not guarantee color matching, long‑term color stability, or resistance to abrasion, solvents, or environmental exposure. Cosmetic wear does not constitute a defect.
ARBITRATION AGREEMENT AND CLASS‑ACTION WAIVER
Any dispute, claim, or controversy arising out of or relating to the purchase or use of NXG Arms products shall be resolved exclusively through binding arbitration administered in accordance with the rules of the American Arbitration Association.
The buyer agrees that all claims must be brought on an individual basis and waives the right to participate in any class action, class arbitration, or representative proceeding.
Judgment on the arbitration award may be entered in any court of competent jurisdiction.
All Sales Final
All sales of NextGen Arms products, including the ARES Line Ruger 10/22 chassis and Cerakote services, are final due to their custom and handcrafted nature. Returns or replacements will only be considered for catastrophic failures directly caused by manufacturing defects. Except for these failures, all products are sold "as is" without additional warranties, express or implied. Cosmetic variations or damage from misuse are not covered.
Proper Use and Installation
To prevent damage, including screw stripping or cross-threading, the ARES Line Ruger 10/22 chassis must be installed using only provided screws and specified tools. Tighten screws with a torque wrench to 18–20 in/lbs, never exceeding 22 in/lbs. Use a ball-head S2 H4.0 Allen wrench (6 inches or longer) for all screws except picatinny button-head screws, which require an S2 H3.0 Allen wrench (flat or ball-end). Failure to follow instructions or misuse voids eligibility for returns or replacements. Product Safety and Usage
NextGen Arms products are designed exclusively for Ruger 10/22 firearms as specified. Installation on incompatible firearms or improper use voids return or replacement eligibility.
Returns for Catastrophic Failures
Catastrophic failures are defined as manufacturing defects rendering the product unusable or unsafe. Claims must be submitted in writing within 30 days of delivery, including photographic evidence and issue details, to Nxgarms@spcprotectionsystems.com. Buyers cover return shipping unless NextGen Arms approves the claim. Eligible returns or replacements will be processed within 14 days of receipt, at our discretion.
Cerakote Services
Customer-provided firearms must be legally owned and comply with applicable laws. NextGen Arms, a Type 07 FFL holder, accepts direct firearm shipments for coating. Cerakote colors depend on stock availability or customer selection, with non-stock colors extending lead time beyond the standard 2–3 weeks. Contact Nxgarms@spcprotectionsystems.com or call 513-532-2079 for availability and lead-time estimates. NextGen Arms is not liable for firearm damage unless due to gross negligence, nor for shipping-related damages. Customers should ensure proper packaging and may opt for shipping insurance. Risk of loss or damage transfers to the buyer upon carrier delivery. Cerakote sales are final once the coating process begins.
Age Verification and Restrictions
Buyers must be at least 18 years old. NextGen Arms may request age or identity verification before fulfilling orders.
Export Control Compliance
Buyers must comply with U.S. export laws, including ITAR and EAR regulations. Unauthorized export is prohibited.
Intellectual Property
Products are protected by intellectual property rights and intended for personal use only. Reverse-engineering, reproduction, or unauthorized modifications are strictly prohibited.
Limitation of Liability
NextGen Arms’ liability is limited to the purchase price of the product. We are not liable for indirect, incidental, or consequential damages arising from product use or misuse.
Payment Terms
Full payment is required at order placement. No refunds are issued for custom products once production begins.
Product Availability and Pricing
NextGen Arms reserves the right to correct pricing errors and cancel orders due to stock limitations or other issues. Affected customers will receive prompt notification and refunds.
Lead Time and Order Fulfillment
Due to custom manufacturing, expect a minimum lead time of 2–3 weeks before shipment. Lead times are estimates and may vary based on order complexity and material availability.
Shipping and Delivery
Buyers are responsible for shipping costs calculated at checkout. Estimated delivery times are not guaranteed. Risk of loss transfers to the buyer upon carrier delivery.
Compliance with Laws
Buyers must ensure compliance with federal, state, and local laws regarding firearm components and complete firearms. Serialized complete rifle sales must be shipped to a licensed Federal Firearms License (FFL) holder chosen by the buyer. Buyers coordinate pickup with their chosen FFL. NextGen Arms reserves the right to refuse orders if legal compliance cannot be verified.
Order Cancellation and Modifications
Custom product orders, including chassis and Cerakote services, cannot be canceled or modified after production begins except at NextGen Arms’ discretion.
Disputes and Inquiries
Submit inquiries or disputes in writing within 30 days of delivery to Nxgarms@spcprotectionsystems.com. Responses will be prompt.
Force Majeure
NextGen Arms is not liable for delays or performance failures due to uncontrollable events, such as natural disasters, regulatory changes, or supply chain disruptions.
Governing Law and Jurisdiction
These Terms of Sale are governed by the laws of Ohio. Disputes will be resolved in the state or federal courts of Ohio.
